This Privacy Policy describes how EMB-S Digital (“EMB-S Digital,” “we,” “us” or “our”) collects, uses, discloses and protects personal information when you visit our websites and landing pages at embs.digital (the “Site”), submit a form, book a call, receive our emails or text messages, or otherwise interact with us (together, the “Services”). By using the Services, you acknowledge that you have read this Privacy Policy.

The short version: we collect the information you give us to prepare your free growth plan, schedule your call and follow up with you. We do not sell your personal information, we never buy or sell leads, and we never share your mobile number or text message consent with third parties for their marketing.

1. Scope

This Policy applies to information we collect through the Services and in business communications with prospective and current clients in the United States. Our Services are intended for businesses, and we collect information about individuals in their capacity as business owners, employees or representatives. Any paid engagement is also governed by the written agreement signed with us.

2. Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information:

  • Identifiers and contact information: name, company name, business email address, phone number, city and state.
  • Business information: the equipment you rent, your service area, locations, marketing goals and any details you share in forms, notes or during calls.
  • Scheduling information: the date, time and time zone of calls you book, and related notes.
  • Communications: the content of emails, text messages and call notes exchanged with us, and your communication preferences and consents.
  • Internet or other electronic network activity: IP address, browser and device type, operating system, pages viewed, time spent, referring URL, and campaign data such as UTM parameters and ad click identifiers.
  • Approximate geolocation: city or region inferred from your IP address. We do not collect precise geolocation.
  • Inferences: limited inferences about your business needs drawn from the information above, used to prepare your plan and follow up.

We do not intentionally collect sensitive personal information such as Social Security numbers, financial account numbers, health information or precise geolocation through the Site. Please do not submit this type of information in our forms.

3. Sources of Information

  • Directly from you, when you fill out a form, book a call, contact us or talk with us.
  • Automatically, through cookies, pixels and similar technologies when you use the Site.
  • From advertising and analytics partners, such as Meta and Google, which tell us which ads or searches led you to the Site.
  • From publicly available sources, such as your company website, business listings and public business profiles.

4. How We Use Information

  • To provide the Services you request, including preparing your free growth plan and conducting your strategy call.
  • To schedule, confirm, reschedule and remind you about calls.
  • To respond to your questions and communicate with you by email, phone and, with your consent, text message.
  • To send marketing communications, where permitted by law and subject to your right to opt out.
  • To prepare proposals and, if you become a client, to perform our agreement with you.
  • To measure, analyze and improve the Site, our advertising and our Services.
  • To detect, prevent and respond to fraud, abuse, security incidents and other harmful activity.
  • To comply with legal obligations, enforce our terms and protect our rights and the rights of others.

5. How We Disclose Information

We do not sell personal information for money, and we never buy or sell leads. We disclose personal information only as described below:

  • Service providers: companies that perform services on our behalf, such as CRM and scheduling platforms, website hosting, email and messaging delivery, video conferencing, analytics and cloud storage. They are contractually limited to using the information to provide services to us.
  • Advertising and analytics partners: platforms such as Meta and Google receive information through cookies and pixels on the Site to measure and optimize our ads. See Section 8 and Section 10 for your choices.
  • Legal and safety: when we believe disclosure is required by law, subpoena or legal process, or is necessary to protect the rights, property or safety of EMB-S Digital, our clients or others.
  • Business transfers: in connection with a merger, acquisition, financing or sale of all or part of our business, subject to this Policy.
  • With your consent or at your direction.

6. Text Messages (SMS)

If you check a consent box on our form and provide your mobile number, you agree to receive text messages from EMB-S Digital at that number. Non-marketing messages relate to your fleet growth plan, strategy call scheduling and reminders. Marketing messages, sent only if you separately consent, include special offers and updates. Messages may be sent using automated technology. Consent is not a condition of any purchase.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. You may also contact us at evian@embs.digital.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from all categories of disclosure described in this Policy and will not be shared with any third parties, except with service providers that deliver the messages on our behalf.

7. Emails

We comply with the CAN-SPAM Act. Every marketing email we send includes a way to unsubscribe. After you unsubscribe, we may still send transactional or relationship messages, such as call confirmations and replies to your requests.

8. Cookies, Pixels and Tracking

We and our partners use cookies, pixels, tags and similar technologies to keep the Site working, remember your preferences, understand how visitors use the Site, measure which campaigns bring visitors and requests, and show relevant ads on other websites and apps (“targeted advertising”).

  • Browser controls: most browsers let you block or delete cookies. Blocking some cookies may affect how the Site works.
  • Ad preferences: you can adjust ad settings in your Meta and Google accounts and learn more about interest-based ads at optout.aboutads.info.
  • Global Privacy Control: we treat a Global Privacy Control (GPC) signal from your browser as a request to opt out of the sharing of your information for targeted advertising for that browser.
  • Do Not Track: there is no common industry standard for “Do Not Track” signals, so the Site does not respond to them, but we honor GPC as described above.

9. Your Privacy Rights

Regardless of where you live, you may ask us to:

  • Tell you what personal information we hold about you and provide a copy.
  • Correct inaccurate personal information.
  • Delete your personal information, subject to legal exceptions.
  • Stop sending you marketing emails or text messages.

To make a request, email evian@embs.digital with the subject “Privacy Request.” We will verify your request by matching information you provide with information we hold. You may use an authorized agent, who must provide proof of your authorization. We will not discriminate against you for exercising your rights.

10. California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, “CCPA”), gives you the rights to know, access, correct and delete your personal information, to opt out of the “sale” or “sharing” of personal information, to limit the use of sensitive personal information, and not to be discriminated against for exercising these rights.

  • Categories collected in the last 12 months: identifiers, professional or commercial information, internet or network activity, approximate geolocation and inferences, as described in Section 2, from the sources in Section 3, for the purposes in Section 4.
  • Disclosures for a business purpose: each of these categories may be disclosed to service providers as described in Section 5.
  • Sale and sharing: we do not sell personal information for money. Allowing advertising partners to collect information through cookies and pixels for cross-context behavioral advertising may be considered “sharing” under the CCPA. You can opt out by emailing evian@embs.digital with the subject “Do Not Sell or Share” or by enabling Global Privacy Control in your browser.
  • Sensitive personal information: we do not use or disclose sensitive personal information for purposes that would give you a right to limit it.
  • Minors: we have no actual knowledge of selling or sharing personal information of consumers under 16.
  • Retention: see Section 12.

California “Shine the Light” law: we do not disclose personal information to third parties for their own direct marketing purposes.

11. Other U.S. State Privacy Rights

Residents of states with comprehensive privacy laws, including Colorado, Connecticut, Delaware, Florida, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah and Virginia, may have rights to confirm whether we process their personal data, to access, correct, delete and obtain a copy of it, and to opt out of targeted advertising, sale or profiling. To exercise these rights, email evian@embs.digital. If we deny your request, you may appeal by replying to our decision with the subject “Privacy Appeal,” and we will respond within the time required by law. If your appeal is denied, you may contact your state Attorney General.

Nevada residents may request that we not sell covered information by emailing us. We do not currently sell covered information as defined under Nevada law.

12. Data Retention

We keep personal information only as long as reasonably necessary for the purposes described in this Policy. Prospect and lead information is generally kept for up to 24 months after our last interaction unless you ask us to delete it sooner. Client information is kept for the duration of the engagement and as required for legal, tax and accounting purposes. Records of consent and opt-outs are kept as long as needed to honor them and to comply with law.

13. Data Security

We use reasonable administrative, technical and physical safeguards designed to protect personal information, including access controls and encrypted connections. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

14. Children's Privacy

The Services are intended for businesses and adults. They are not directed to children under 13, and we do not knowingly collect personal information from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA). If you believe a child has provided us personal information, contact us and we will delete it.

15. International Data Transfers

EMB-S Digital and some of our service providers operate outside the United States, including in Brazil. Your information may be transferred to, stored and processed in countries other than the one where you live. When we do so, we protect it as described in this Policy.

16. Third-Party Links

The Site may link to third-party websites and services, such as scheduling and video meeting tools. We are not responsible for the privacy practices of third parties, and we encourage you to read their privacy policies.

17. Changes to This Policy

We may update this Policy from time to time. We will post the updated version on this page and change the “Last updated” date above. If changes are material, we will provide additional notice as required by law.
